1. Acceptance of Terms
By downloading, installing, or using TEN78 ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App. We reserve the right to update these terms at any time, and your continued use of TEN78 after any modifications constitutes acceptance of the revised terms.
2. Description of Service
TEN78 is a mobile reference application that provides Ontario traffic and regulatory legislation data for informational purposes. The App aggregates publicly available charge information, fine amounts, demerit points, and legislation text into a searchable, offline-capable format designed for law enforcement professionals working in the Province of Ontario.
3. Disclaimer — Not Legal Advice
TEN78 is an informational tool only and does not constitute legal advice. The App is not a substitute for professional legal counsel, official government publications, or verified legislative databases. Legislation data is sourced from public Ontario government resources but may contain errors, omissions, or may not reflect the most recent legislative amendments. Users should always verify charges, fine amounts, demerit points, and legislation text against official sources before relying on them in any professional or legal capacity.
4. Ontario Only
TEN78 covers Ontario provincial legislation only. The App does not include federal statutes or regulations, municipal bylaws, or legislation from any other Canadian province or territory. Users operating outside of Ontario's legislative jurisdiction should not rely on TEN78 for applicable law.
5. Accuracy
While we strive for accuracy and regularly update the App's database, we make no guarantees, representations, or warranties that charge information, fine amounts, demerit points, set fine schedules, or legislation text contained within TEN78 is complete, correct, or current. Ontario legislation is subject to change, and updates may not be reflected in the App immediately. Discrepancies between the App's content and official legislative sources should always be resolved in favour of the official source.
6. Use at Your Own Risk
You assume full responsibility for how you use the information provided by TEN78. Any actions you take based on the information contained in the App are taken at your own risk. TEN78 is intended as a supplementary reference tool and should not be the sole basis for any enforcement action, legal proceeding, or professional decision.
7. Intellectual Property
The TEN78 name, logo, visual design, user interface, and original content are the intellectual property of TEN78 and are protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works based on TEN78's proprietary elements without prior written consent.
Ontario legislation text reproduced within the App is Crown copyright, Province of Ontario, and is made available under the terms of the Ontario Open Government Licence. Use of this legislative content is subject to the terms and conditions of that licence.
8. Limitation of Liability
To the fullest extent permitted by applicable law, TEN78, its developers, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the App. This includes, without limitation, damages for errors or omissions in legislation data, loss of data, loss of professional opportunity, or any other loss or damage of any kind, even if TEN78 has been advised of the possibility of such damages.
9. Termination
We reserve the right to modify, suspend, or discontinue TEN78, in whole or in part, at any time and without prior notice or liability. We may also restrict or terminate access to certain features or the entire App at our sole discretion. Upon termination, your right to use the App ceases immediately.
10. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
